CONTEXT & COMMENTS

Def.: A period during which the Government delays prosecution of an offender so that he can fulfill certain conditions and not suffer a conviction.
       • Mr. Hernandez received deferred prosecution in his case because he did not have a criminal record and the amount of marijuana that he crossed with was very small.
 
Note: Compare with deferred entry of judgment, in which an offender must plead guilty in order to participate in the program.
