WHEREAS the United States Marshal for this district
has sought relief from his duties of seizing and storing property under Federal
Rules of Civil Procedure, Supplementary Rule E, in order to conserve his limited
manpower and budgetary resources; and
WHEREAS the present practice with regard to seized property
often involves unnecessary duplication of action and expenditure of additional federal
funds and manpower; and
WHEREAS by so conserving the limited manpower and budgetary
resources of the United States Marshal he will be able to better meet the judicial
and court-related duties for which he is responsible,
IT IS HEREBY ORDERED that the initiating governmental
party or agency shall provide the court an order for substitute custodian for the
applicable property to be seized and that a certified copy of said order shall be
attached by the clerk to all writs of execution or warrants of arrest in rem before
their issuance in this district.
IT IS FURTHER ORDERED that this General Order shall
become effective upon its filing and that the Clerk shall provide to the United
States Marshal such certified copies of this order as the Marshal may need to provide
notice to interested parties.
